Agreement
These Terms of Service ("Terms") govern your access to and use of the Forcst website at forcst.xyz, the app at app.forcst.xyz, and related services (together, the "Service"), provided by Forcst ("Forcst," "we," "us" or "our").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you confirm that you're authorized to accept these Terms for it, and "you" includes that organization. If you don't agree, don't use the Service.
Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to use the Service. You sign in with a Google account, and you're responsible for keeping that account secure and for all activity under your Forcst account.
Give us accurate information, keep it up to date, and tell us promptly at support@forcst.xyz if you suspect unauthorized use. Accounts are personal and may not be shared or transferred.
The Service
Forcst builds models of real cities from public and licensed data and simulates how a business, new or established, could perform over time at a given location or online. Features include simulations over different horizons, what-if scenarios, simulated community feedback, saved history and data exports.
We're constantly improving Forcst, so features, data coverage and limits may change. We may add, change or remove features, and we'll give reasonable notice of changes that materially reduce what a paid plan includes.
Forecasts are estimates, not advice
Forcst produces models, not predictions you should rely on alone. Simulations, forecasts, scores and other outputs are estimates based on available data, statistical assumptions and AI, and real results can differ significantly.
Outputs may be incomplete, out of date or wrong. Public datasets have gaps and lags, and conditions such as competition, the economy, regulation and your own execution change in ways no model can fully capture.
Nothing in the Service is financial, investment, legal, tax, accounting, real estate or other professional advice, and using it doesn't create a professional relationship. You're solely responsible for your business decisions, including leases, loans, hiring and investments. Before making significant commitments, consult qualified professionals and do your own diligence.
Plans, billing and cancellation
Free and Pro
Forcst offers a free plan with a limited set of cities and features, and a paid Pro subscription. What each plan includes is described in the app and on our website, and may change over time.
Subscriptions
- Price. Pro is billed monthly in advance at the price shown at checkout. Promotional prices, such as a reduced first month, apply only for the period stated in the offer.
- Automatic renewal. Your subscription renews automatically each month, and you authorize us and our payment processor to charge your payment method on each renewal until you cancel.
- Cancellation. Cancel anytime from the account menu in the app ("Manage or cancel subscription"). Cancellation takes effect at the end of the current billing period: you keep Pro until then, and you won't be charged again.
- Refunds. Except where required by law, payments are non-refundable, and we don't provide refunds or credits for partial months or unused features.
- Price changes. We may change subscription prices. We'll notify you at least 30 days in advance, and the new price applies from your next billing period after that notice. If you don't agree, you can cancel before it takes effect.
- Taxes. Prices don't include taxes. Sales tax, VAT or similar taxes are added where they apply.
- Failed payments. If a payment fails, we may retry it, and Pro features may be suspended until the balance is paid.
Payment processing
Payments are processed by Stripe. Stripe may act as the merchant of record for your purchase, in which case Stripe's own terms also apply to the transaction and Stripe handles related tax, receipts and payment disputes. We never receive your full card details.
Acceptable use
You agree not to:
- use the Service for anything unlawful, deceptive or harmful, or in violation of others' rights;
- scrape, crawl or bulk-download the Service, its data or its outputs, except through features we provide for that purpose;
- resell, sublicense or redistribute the Service, or use it to build a competing product or dataset;
- reverse engineer, decompile or try to extract source code, models or underlying data, except where the law expressly permits;
- get around usage limits, plan restrictions, payment or security measures, or access accounts or data that aren't yours;
- interfere with or overload the Service, or introduce malware;
- submit content that infringes others' rights or contains other people's sensitive personal information without permission;
- use outputs to make eligibility decisions about individuals, such as credit, employment, insurance or housing.
Your content
"Your content" means the information you put into the Service, such as business details, locations, figures and scenarios. You keep all rights to it. You give us a worldwide, non-exclusive, royalty-free license to host, process and display your content only as needed to provide, secure and improve the Service, including through the service providers described in our Privacy Policy.
We don't sell your content, and we don't use it to train AI models. You're responsible for your content and for having the rights to submit it.
If you send us feedback or suggestions, we may use them without any obligation to you.
Our content and third-party data
The Service, including its software, design, models, city reconstructions, text and branding, belongs to Forcst and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal business purposes.
The Service draws on third-party data, including the US Census Bureau, the Bureau of Labor Statistics, OpenStreetMap, real estate market research and news sources. That data remains subject to its owners' terms and licenses. Map data is © OpenStreetMap contributors and available under the Open Database License. Exported data is for your internal use and must keep any required attributions.
AI features and simulated personas
Some features are powered by AI models from third-party providers. AI output can be inaccurate, incomplete or inconsistent, so review it before relying on it.
Community feedback in Forcst comes from simulated personas generated from aggregate public data. They are not real people, and their reactions aren't surveys, reviews or endorsements.
Third-party services
The Service works with third-party services, such as Google for sign-in and Stripe for payments, and may link to third-party websites. Their terms and privacy policies govern your use of them. We're not responsible for third-party services, content or data, and their availability may affect parts of the Service.
Suspension and termination
You can stop using the Service at any time, and you can ask us to delete your account by emailing support@forcst.xyz. Cancel any active subscription first so you aren't billed again.
We may suspend or end your access if you breach these Terms, if your use creates risk or legal exposure for us or others, or if we're required to by law. Where reasonable, we'll notify you first and give you a chance to fix the problem. If we end the Service for reasons other than your breach, we'll refund any prepaid fees for the unused part of your billing period.
Sections that by their nature should survive termination, including those on content, disclaimers, limitation of liability, indemnification and governing law, will survive.
Disclaimers
The Service and all outputs are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don't warrant that the Service will be uninterrupted, error-free or secure, or that any forecast or data will be accurate, complete or current.
Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Forcst and its affiliates, officers, employees and suppliers won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising from or related to the Service or these Terms, even if advised of the possibility of such damages. This includes losses from business decisions made using the Service.
Our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US $100.
These limits apply to every theory of liability and still apply if a remedy fails of its essential purpose. They don't limit liability that can't be limited by law.
Indemnification
You agree to defend, indemnify and hold harmless Forcst and its affiliates, officers and employees from any claims, damages, losses and expenses, including reasonable legal fees, arising from your content, your misuse of the Service or your violation of these Terms or of others' rights.
Governing law and disputes
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Michigan, and you and Forcst consent to their jurisdiction. If you're a consumer, this doesn't deprive you of any mandatory protections of the laws where you live.
Before filing a claim, please contact us at support@forcst.xyz so we can try to resolve the issue informally. Most concerns can be settled quickly this way.
Changes to these terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above. For material changes, we'll notify you by email or in the app at least 15 days before they take effect. Continuing to use the Service after changes take effect means you accept them.
These Terms, together with the Privacy Policy, are the entire agreement between you and Forcst about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
